This is the approach taken by the s. 26 of the Unfair Contract Terms Act 1977 as well as Article 1 of the United Nations Convention on Contracts for the International Sale of Goods (CISG hereafter).1 Many types of risks are being borne by long distance sellers in an international sale of goods, which include, inter alia: the uncertainty resulting from the transit of goods by sea; possible political uncertainty; conflict of law, and; payment issues. 1.1 The Uncertainty Brought About by Transit of Goods by Sea It has been said that the management of international business is the management of risk, a fair assessment considering the geog raphical distance between parties and the political and legal disparities between and among various jurisdictions. International sale of goods is complicated by the likely sea transit of goods. The uncertainty of having the goods travel from one point to the other for a considerable period of time from the time the seller brings his goods to the carrier for shipment to the time these goods are actually delivered to the buyer often entails risks that parties are eventually forced to assume. Thus, it is an often told tale in the international business world of goods damaged, spoiled, rusted, contaminated or lost while aboard vessels or when the vessels sink because of bad weather as they are being taken from one point to another. 2 1.2 Conflict of Laws Additionally, when a transaction of sale of goods involves parties coming from different states or countries a conflict of laws is likely to ensue. Thus, when conditions necessitating resolutions of dispute regarding the contract crop u p, the problem of what law should govern the interpretation of the contract as well as the proper forum of the dispute resolution become a problem. After resolution, the problem of enforcing them in the other jurisdiction remains.3 1.3 Problems Pertaining to Payment If the sale, for example, is agreed to be on credit terms the main problem of the seller is how to ensure payment. The use of marijuana and the effects vary from user to user depending on the method of intake, but the most common mode of intake by most users who use it is through smoking of the dried leaves, stems or the seeds. It may also be ground and taken with other food substances such as tea or sprinkled with other food additives. The THC once absorbed in the blood has some short term and long-term effects to the user depending on the number of joints smoked. The chemical can st ay in the blood streams and brain for time ranging from 10 minutes to 8-10 hours, and affect users differently also as they differ in levels of drug handling capabilities. Small amounts of the plant enhance the user’s perception of the world and heighten the appreciation of music, foods and increases brain functions. Long terms effects reduces the amount of oxygen that reaches the blood and increases the levels of carbon monoxide in the brain cells that leads to alteration of the brain functions of the users. This reduced oxygen reduces the thinking ability of the user, causes drowsiness and restlessness. The user may also suffer from hallucinations and the extended sense that he/she owns the world or they are beyond the others. The THC in the blood enters the heart vessels and reduces the amount of oxygen that enters the heart to be pumped to other parts of the body. This in the long run over works the heart as it tries to pump more blood throughout the body to meet the oxyg en deficit. The heart increases the heartbeats to pump more blood making heart muscles to weaken, thus, the user may die of heart failure or heart attack as he/she continues to use marijuana in their blood stream. Since the user gets a heightened sense of surroundings, he/she becomes what is termed as ‘high’ and may become a nuisance to the others in the community. Cannabis may also make the user to be irritated by others in society and may turn aggressive as they try to assert their position. The term â€Å"chivalry† refers to one of the most popular medieval social ideals. Indeed, this term has excited the imagination of poets and readers throughout history, and modern cultures continue to revise the chivalric ideals of past ages. However, pinpointing what the term meant within the medieval period is difficult at best. The source of this difficulty lies within the fact that there was never one consistent definition for chivalry. Indeed, the meaning of the word seems to shift between cultures and throughout time. For example, the earliest usage of the word seems to denote only mounted cavalry; however, as time shifts, the word becomes synonymous with certain martial ideals. As the period progresses, the ideal of chivalry encompasses a more total social paradigm, incorporating a wide array of ideals including honor, hospitality, and love. Even this rough outline of chivalry’s history fails to account for the shifting ground that surrounds this t erm. However, regardless of an individual culture or poet’s conception of chivalry, it remained a popular ideal. Indeed, it was most often communicated within the genre of romance, and romance is among the most popular of medieval genres. Often times, these romances not only celebrate the ideal of chivalry but they also examine and critique it. Certainly, the form of the romance offers a perfect vehicle for this exercise. Whereas epic heroes are different from ordinary people by kind, the heroes of romance are different only by degree. While they may be a little stronger, a little smarter, or a little more honorable than the average person, we see within their victories the victories of the culture, and we experience within their failures the failures of the social... ...on seems to point towards the sort of cross-factionalism that the chivalric order demands. When Lancelot destroys him, he is in effect destroying the tie that binds the factions together, and Gawain reacts with rage. When the smoke clears, Gawain and Arthur are dead, and the dream of Camelot is destroyed. The critique here seems to be on humankind more than chivalry, for while chivalry stands as a great ideal, the men and women of Camelot were unable to subordinate their own desires to it. As with Gawain and the Green Knight, the text examines the most perfect example of chivalry that has existed and finds it flawed. In this way, medieval romance walks a delicate path between honoring the chivalric ideals and critiquing their execution. Ultimately, these texts seem to criticize humanity’s inability to live up to the code as often as they do the code itself.
